On the Supreme Council of the Autonomous Republic of Crimea

The Law of Ukraine “On the Supreme Council of the Autonomous Republic of Crimea” (hereinafter referred to as “the Law”) determines authorities, procedure for organization and activity of the Supreme Council of the Autonomous Republic of Crimea. The Supreme Council of the Autonomous Republic of Crimea is the representative body of the Autonomous Republic of Crimea, which executes its authorities on the basis of the Constitution of Ukraine and the laws of Ukraine, the Constitution of the Autonomous Republic of Crimea and normative legal acts of the Autonomous Republic of Crimea with the purpose of promoting the exercise of rights and interests of the population of the autonomy and solution of issues of vital activity of the region. Activity of the Supreme Council of the Autonomous Republic of Crimea is determined by the Constitution of Ukraine, this Law, the Constitution of the Autonomous Republic of Crimea, the Regulation of the Supreme Council of the Autonomous Republic of Crimea, as well as other normative legal acts of the Supreme Council of the Autonomous Republic of Crimea within the limits of its authorities.

The Supreme Council of the Autonomous Republic of Crimea consists of 100 deputies, which are elected on the basis of universal, equal and direct franchise by secret ballot. The Chairman of the Supreme Council of the Autonomous Republic of Crimea, his first assistant and assistant, the heads of permanent commissions the Supreme Council of the Autonomous Republic of Crimea execute their authorities on a permanent basis. The term of authorities of the Supreme Council of the Autonomous Republic of Crimea is four years. The Supreme Council of the Autonomous Republic of Crimea is authoritative provided that not less than two thirds of its total staff are elected. Authorities of the Supreme Council of the Autonomous Republic of Crimea of preliminary convocation are terminated from the moment of opening the first session of the Supreme Council of the Autonomous Republic of Crimea of a new convocation. Authorities of the Supreme Council of the Autonomous Republic of Crimea may be early terminated by the Verkhovna Rada of Ukraine on the grounds and according to the procedure determined by the Constitution of Ukraine.

The deputy of the Supreme Council of the Autonomous Republic of Crimea may be a citizen of Ukraine who has the right to vote, is 18 years old on the day of elections and resides in Ukraine for at least five years. A citizen who has convictions for commitment of deliberate crime, if the convictions are not spent and cancelled according set by law procedure cannot be the elected to the Supreme Council of the Autonomous Republic of Crimea. The deputies of the Supreme Council of the Autonomous Republic of Crimea who work on a permanent basis do not have the right to combine their official activity with other job, except for teaching, scientific and creative one in spare time, be a member of management body or supervisory board of the enterprises that aim at profit receipt.

A deputy of the Supreme Council of the Autonomous Republic of Crimea has all rights, which ensure his active participation in the activity of the Supreme Council of the Autonomous Republic of Crimea and its bodies and executes their instructions. For the time of holding sessions of the Supreme Council of the Autonomous Republic of Crimea, permanent commissions of the Supreme Council of the Autonomous Republic of Crimea, as well as for the exercise of deputy authorities in other cases envisaged in this Law a deputy is freed from the fulfillment of production or official duties with the compensation to him of annual salary at the basic job and other expenses connected with deputy activity at the expense of funds of the Autonomous Republic of Crimea. A deputy shall participate in the work of the Supreme Council of the Autonomous Republic of Crimea and its bodies. A deputy of the Supreme Council of the Autonomous Republic of Crimea shall not use his deputy mandate for the purposes that are not connected with deputy activity. Authorities of a deputy of the Supreme Council of the Autonomous Republic of Crimea shall be terminated simultaneously with the termination of authorities of the Supreme Council of the Autonomous Republic of Crimea. Authorities of a deputy of the Supreme Council of the Autonomous Republic of Crimea are early terminated upon the decision of the Supreme Council of the Autonomous Republic of Crimea in the following cases:
- resignation by personal application, recall by the voters;
- entry into legal force of sentence of court as regards to him, his recognition by court as disable or missing;
- termination of the citizenship of Ukraine or departure for permanent residence outside Ukraine;
- death, and other cases envisaged by the current legislation.
The grounds for recall by the voters of a deputy elected by them shall be:
- violation by the deputy of the Constitution and the laws of Ukraine, other legislative acts of Ukraine, constitution and normative legal acts of the Autonomous Republic of Crimea;
- unsatisfactory fulfillment of deputy duties determined by this Law and other laws of Ukraine;
- use of deputy mandate for personal and selfish purposes, systematical violation of ethic and moral norms.

Activity of the Supreme Council of the Autonomous Republic of Crimea is performed by sessions and consists of the plenary sessions of the Supreme Council of the Autonomous Republic of Crimea and sessions of its bodies. The Supreme Council of the Autonomous Republic of Crimea assembles for the first session not later than on the thirtieth day after election of not less than two thirds of set number of deputies.

The Supreme Council of the Autonomous Republic of Crimea performs normative regulation of the following issues:
- agriculture and forestry, melioration and open-pits;
- public works, handicrafts and trades; charity, town-planning and housing;
- tourism, hotel business, fares, museums, libraries, theatres, other cultural establishments and historical cultural reserves;
- transport of common use, motor roads, water pipes, sanitary and healthcare services, etc.
The Supreme Council of the Autonomous Republic of Crimea also deals with:
- adoption of decision about holding local referendum;
- determination of the procedure for managing property that belongs to the Autonomous Republic of Crimea;
- determination of the list of property of the Autonomous Republic of Crimea that shall not be subject to privatization;
- setting taxes and tax allowances according to the Laws of Ukraine;
- making decisions about issue of local loans;
- approval of the regulations of the Supreme Council of the Autonomous Republic of Crimea, etc.

The Supreme Council of the Autonomous Republic of Crimea adopts the Constitution of the Autonomous Republic of Crimea and introduces amendments to it, which come into force after their approval by the Verkhovna Rada of Ukraine. The Supreme Council of the Autonomous Republic of Crimea within it authorities adopts normative legal acts that are binding on the territory of the Autonomous Republic of Crimea.
At the first session the Supreme Council of the Autonomous Republic of Crimea elects from the deputies the Chairman of the Supreme Council of the Autonomous Republic of Crimea, his first assistant and assistant. Each deputy votes personally by bulleting, putting the bulleting to the voting box. The Chairman of the Supreme Council represents the Supreme Council of the Autonomous Republic of Crimea in its relations with the central and local bodies of power of Ukraine, bodies of local self-government, enterprises, institutions and organizations, citizens, as well as their associations, performs other authorities. 

The Chairman of the Supreme Council of the Autonomous Republic of Crimea has the first assistant and assistant, which are elected by the Supreme Council of the Autonomous Republic of Crimea from its deputies for the term of authorities of the Supreme Council of the Autonomous Republic of Crimea by secret ballot. The first assistant, the assistant of the Chairman of the Supreme Council of the Autonomous Republic of Crimea substitute the Chairman of the Supreme Council of the Autonomous Republic of Crimea in case of his absence or temporary impossibility to perform his duties. Distribution of duties between the assistants of the Chairman of the Supreme Council of the Autonomous Republic of Crimea is set by the regulations of the Supreme Council of the Autonomous Republic of Crimea.

In order to coordinate the work of bodies of the Supreme Council of the Autonomous Republic of Crimea, promote deputies in fulfillment of their duties, prepare sessions, execute other authorities of organizational nature that are transferred to it by the Supreme Council of the Autonomous Republic of Crimea the Presidium of the Supreme Council of the Autonomous Republic of Crimea is created. The Presidium of the Supreme Council of the Autonomous Republic of Crimea consists of the Chairman of the Supreme Council of the Autonomous Republic of Crimea, his first assistant and assistant, heads of permanent commissions of the Supreme Council of the Autonomous Republic of Crimea. The Presidium of the Supreme Council of the Autonomous Republic of Crimea is headed by the Chairman of the Supreme Council of the Autonomous Republic of Crimea. The Presidium of the Supreme Council of the Autonomous Republic of Crimea calls sessions of the Supreme Council of the Autonomous Republic of Crimea and organizes their preparation, forms the agenda and brings it for the approval of the Supreme Council of the Autonomous Republic of Crimea, coordinates works of the bodies of the Supreme Council of the Autonomous Republic of Crimea, ensures registration and official publishing of normative legal acts of the Supreme Council of the Autonomous Republic of Crimea.

Permanent and temporary commissions of the Supreme Council of the Autonomous Republic of Crimea are the bodies of the Supreme Council of the Autonomous Republic of Crimea that are elected from its deputies for study, preliminary consideration and drafting of the issues under its jurisdiction, conducting control over fulfillment of resolutions and decisions of the Supreme Council of the Autonomous Republic of Crimea. Permanent commissions are elected by the Supreme Council of the Autonomous Republic of Crimea for the term of its authorities and consist of head, his assistant, secretary and other members of commission. Permanent commissions shall consist of not less than eight and not more than fifteen deputies. The Chairman of the Supreme Council of the Autonomous Republic of Crimea and his assistants cannot be elected to the permanent and temporary commissions.

Activity of the Supreme Council of the Autonomous Republic of Crimea is ensured by the staff of the Supreme Council of the Autonomous Republic of Crimea, which consists of the Secretariat of the Supreme Council of the Autonomous Republic of Crimea and the Department for Affairs of the Supreme Council of the Autonomous Republic of Crimea. The Secretariat of the Supreme Council of the Autonomous Republic of Crimea performs organizational, legal, codification, expert, informational, documentary and other provision of activity of the Supreme Council of the Autonomous Republic of Crimea, its bodies and deputies of the Supreme Council of the Autonomous Republic of Crimea by establishment of respective subdivisions. The Department for Affairs of the Supreme Council of the Autonomous Republic of Crimea performs operative management of property and finances, material technical provision of the Supreme Council of the Autonomous Republic of Crimea and its bodies.

Expenses for ensuring activity of the Supreme Council of the Autonomous Republic of Crimea are envisaged by a separate line in the Budget of the Autonomous Republic of Crimea. The estimate of expenses connected with the activity of the Supreme Council of the Autonomous Republic of Crimea and its bodies, of deputes of the Supreme Council of the Autonomous Republic of Crimea is approved by the Supreme Council of the Autonomous Republic of Crimea.
