On Chambers of Commerce and Industry in Ukraine

The Law determines general legal, economic and social grounds for establishment of chambers of commerce and industry in Ukraine, sets forth organizational and legal forms and fields of their activity, as well as principles of their relations with the state.

Chambers of commerce and industry are created with the purpose of facilitating development of businesses and national economy, its integration into the world economic system, formation of modern industrial, financial and trade infrastructures.
A chamber of commerce and industry is a non-government non-profit self-governing organization that unites legal entities, which have been created and function in accordance with the legislation of Ukraine, and Ukrainian citizens registered as entrepreneurs, and their associations.

The Law determines the procedure for establishment chambers of commerce and industry and termination of their activity. Chambers of commerce and industry are created on the territory of the Autonomous Republic of Crimea, oblasts, cities of Kyiv and Sevastopol (regional chambers of commerce and industry). Only one chamber of commerce and industry may be created within each of the aforementioned administrative territorial units.

The Ukrainian Chamber of Commerce and Industry functions on the territory of Ukraine.

A chamber of commerce and industry is set up on the initiative of not less than 50 founders that are located in a respective territory.

Only legal entities, that have been set up and function in line with the legislation of Ukraine, and the citizens of Ukraine, registered as the entrepreneurs, and their associations may be the members of a chamber of commerce and industry.

The Law determines requirements to statutory documents of chambers of commerce and industry and the procedure for state registration of the Ukrainian Chamber of Commerce and Industry and regional chambers of commerce and industry.

In accordance with the law, chambers of commerce and industry have the following rights:
- to conduct independent examination of drafts of normative legal acts on economy and foreign economic relations by order of the state bodies;
- to represent and protect legal interests of chamber of commerce and industry or upon instruction of its members – their interests;
- to render, by order of  Ukrainian and foreign legal entities and natural persons, services connected with protection of their rights and interests in accordance with the legislation of Ukraine and international agreements of Ukraine;
- to conduct, upon requests of Ukrainian and foreign entrepreneurs, expertise, control of quality, quantity and completeness of assembly of good (including those for export and import) and determine their cost;
- to attest and issue certificates of goods origin, certificates determining products manufactured by the enterprises with foreign investments and other documents relating to foreign economic activity;
- to create, reorganize, close down enterprises and other organization with the purpose of carrying out statutory tasks according to the procedure, established by the law;
- to set up, by order of parties to a dispute, the courts of arbitration pursuant to the legislation of Ukraine, branch or territorial committees (councils) of entrepreneurs, target-oriented groups of experts consultants;
- to perform other authorities that do not run counter to the legislation of Ukraine.

Methodical and expert documents, issued by chambers of commerce and industry within their authorities, are mandatory for application on the whole territory of Ukraine.

The Law establishes special status of the Ukrainian Chamber of Commerce and Industry. The members of the Ukrainian Chamber of Commerce and Industry are chambers of commerce and industry, created in accordance with the present law, legal entities, which have been set up and are operating in accordance with the legislation of Ukraine and the citizens of Ukraine, registered as entrepreneurs, as well as their associations.

The Ukrainian Chamber of Commerce and Industry, according to the Law and its Statute, performs representative functions in Ukraine and beyond its borders, unites chambers of commerce and industry and coordinates their actions.

The functions of the Ukrainian Chamber of Commerce and Industry, in particular, include attesting of force major events in accordance with the conditions of foreign trade agreements and international agreements of Ukraine, as well as trade and port procedures, accepted in Ukraine.

The International Commercial Arbitration Court and the Maritime Arbitration Commission, which activity is regulated by the Ukrainian legislation, are operating at the Ukrainian Chamber of Commerce and Industry.

The Ukrainian Chamber of Commerce and Industry represents interests of its members in the International Chamber of Commerce and in other international organizations on issues of entrepreneurial activity.
