“On Amendments to the Rules of Procedure of the Verkhovna Rada of Ukraine”

The Rules of Procedure of the Verkhovna Rada of Ukraine (hereinafter referred to as “Rules of Procedure”) were adopted by the Law of Ukraine “On the Rules of Procedure of the Verkhovna Rada of Ukraine” N1861-VI of February 10, 2010.

According to Article 1 of the Rules of Procedure, the operating procedures of the Verkhovna Rada of Ukraine, its bodies and officials, the principles of establishment, organization of activities and dissolution of parliamentary factions (parliamentary groups) of the Verkhovna Rada of Ukraine shall be regulated by the Constitution of Ukraine, the Rules of Procedure of the Verkhovna Rada of Ukraine, and the Laws of Ukraine "On Committees of the Verkhovna Rada of Ukraine", "On Status of People's Deputy of Ukraine", and "On Interim Investigating Commissions, a Special Interim Investigating Commission and Special Interim Commissions of the Verkhovna Rada of Ukraine". The Rules of Procedure establish the procedure for preparing and holding sessions of the Verkhovna Rada of Ukraine, its meetings, creation of state authorities, establishes the legislative procedure, the procedure for reviewing other issues within the scope of its authority, and the procedure for exercising the control functions of the Verkhovna Rada of Ukraine.

The Law presents a new version of part 1, Article 26 of the Rules of Procedure, according to which, before the start of each plenary meeting, people’s deputies are registered in person, presenting their identification of a people’s deputy and confirming their presence by signature. In the Verkhovna Rada of Ukraine session hall, a people’s deputy registers their presence using the electronic system, in a way that makes it impossible for another person to register in their stead (previous version – before the start of each plenary meeting, people’s deputies are registered in person, presenting their identification of a people’s deputy and confirming their presence by signature, as well as using the electronic system).

According to the amendments to clause 1, part 2, Article 37 of the Rules of Procedure, open voting is done by each people’s deputy in person, using the electronic system in a way that would make it impossible for another person to vote instead of the people’s deputy. The vote results are recorded in a roll call, which may be printed out. By demand of people’s deputies, the voting results may be viewed on the information screen of the electronic system in the session hall, broken down by parliamentary fractions (parliamentary groups).

The new version of part 3, Article 47 of the Rules of Procedure envisages that voting is done by people’s deputies in person, using the electronic voting system, in the session hall of the Verkhovna Rada of Ukraine, in a way that makes it impossible for another person to vote on behalf of a people’s deputy, or in an area near the plenary session hall, designated for secret ballot (previous version – voting is done by people’s deputies in person, using the electronic voting system, in the session hall of the Verkhovna Rada of Ukraine, or in an area near the plenary session hall, designated for secret ballot).

The Law also envisages that Article 47 of the Rules of Procedure is supplemented with another part, according to which a people’s deputy must not obstruct the review of an agenda item at a plenary meeting, including by blockading the tribune, interfering with the work of the head of the plenary meeting, or with the voting of other people’s deputies.
The Law aims to provide legislative implementation for provisions of Article 84 of the Constitution of Ukraine and Article 2 of the Law of Ukraine, according to which:
  • voting at the sessions of the Verkhovna Rada of Ukraine is done by a people’s deputy of Ukraine in person;
  • a people’s deputy of Ukraine shall, in particular: 1) personally participate in voting on the issues reviewed by the Verkhovna Rada of Ukraine and its bodies; and 2) adhere to the work discipline and deputy ethics norms.
