“On Amendments to the Rules of Procedure of the Verkhovna Rada of Ukraine”

The Rules of Procedure of the Verkhovna Rada of Ukraine (hereinafter referred to as “Rules of Procedure”) were adopted by the Law of Ukraine “On the Rules of Procedure of the Verkhovna Rada of Ukraine” N1861-VI of February 10, 2010.

According to Article 1 of the Rules of Procedure, the operating procedures of the Verkhovna Rada of Ukraine, its bodies and officials, the principles of establishment, organization of activities and dissolution of parliamentary factions (parliamentary groups) of the Verkhovna Rada of Ukraine shall be regulated by the Constitution of Ukraine, the Rules of Procedure of the Verkhovna Rada of Ukraine, and the Laws of Ukraine "On Committees of the Verkhovna Rada of Ukraine", "On Status of People's Deputy of Ukraine", and "On Interim Investigating Commissions, a Special Interim Investigating Commission and Special Interim Commissions of the Verkhovna Rada of Ukraine". The Rules of Procedure establish the procedure for preparing and holding sessions of the Verkhovna Rada of Ukraine, its meetings, creation of state authorities, establish the legislative procedure, the procedure for reviewing other issues within the scope of its authority, and the procedure for exercising the control functions of the Verkhovna Rada of Ukraine.

The Law presents a new version of part 2, Article 13 of the Rules of Procedures, according to which delegation to the Preparatory Parliamentary Group is done as follows:
  • political parties with deputy mandates distributed in the voting list delegate one representative per 15 people’s deputies elected in the national or single-mandate electoral districts. If eight or more people’s deputies remain unaccounted for after the distribution of this quota, one additional representative of such political party is suggested. The written proposal of the representative of a political party, signed by the head of the respective political party, is submitted to the Head of the Verkhovna Rada of Ukraine, and in case of their absence, to the First Deputy Head or Deputy Head of the Verkhovna Rada of Ukraine, within five days after the official announcement of the election results by the Central Election Commission;
  • people’s deputies elected in single-mandate electoral districts, registered as people’s deputy candidates through self-nomination, delegate one representative per 15 people’s deputies. The written proposal of their representative, signed by at least 15 people’s deputies, is submitted to the Head of the Verkhovna Rada of Ukraine, and in case of their absence, to the First Deputy Head or Deputy Head of the Verkhovna Rada of Ukraine, within five days after the official announcement of the election results by the Central Election Commission.

The new version of part 1, Article 16 of the Rules of Procedure envisages the following review order for issues at the plenary meetings of the first session of a newly-elected Verkhovna Rada:
  • creating the Temporary Presidium of the first session;
  • creating and registering parliamentary factions (parliamentary groups);
  • report of the Head of the Verkhovna Rada of Ukraine of the previous convocation on the state of legislative work in the parliament;
  • electing the Counting Board;
  • electing the Head of the Verkhovna Rada of Ukraine;
  • electing the First Deputy Head and Deputy Head of the Verkhovna Rada of Ukraine;
  • hearing out the unscheduled address of the President of Ukraine on the internal and external position of Ukraine;
  • hearing out the report of the Preparatory Parliamentary Group, question and answer session with the speaker;
  • on committees;
  • on the Coordination Board of the parliamentary factions (parliamentary groups) in the Verkhovna Rada of Ukraine;
  • on coverage of the work of the Verkhovna Rada of Ukraine.

According to the new version of part 2, Article 17 of the Rules of Procedure, the Counting Board is elected by the Verkhovna Rada of Ukraine based on the principle of proportionate representation of parliamentary factions (parliamentary groups), by a majority vote of the constitutional membership of the Verkhovna Rada of Ukraine, in an open roll call vote on a list, without discussing the list.

The temporary presidium of the first session of the Verkhovna Rada of Ukraine consists of six people’s deputies. Its members include the Head of the Preparatory Parliamentary Group, and one representative per political party with deputy mandates distributed in the voting list. Members of the Temporary Presidium of the first session of the Verkhovna Rada of Ukraine take turns carrying out the duties of the head of the plenary meeting. Each member of the Temporary Presidium of the first session of the Verkhovna Rada of Ukraine acts as the head during one plenary meeting. The order is determined by the number of deputy mandates received by the party in the national electoral district. The first member of the Preparatory Parliamentary Group to head the plenary meeting after the Head of the Preparatory Parliamentary Group is the representative of the political party that has received the most deputy mandates (new version of parts 1 and 2, Article 18 of the Rules of Procedure).

According to the new version of part 1, Article 58 of the Rules of Procedure, parliamentary factions are formed of people’s deputies elected from the voting lists of political parties and people’s deputies nominated by a political party in single-mandate districts. During creation of a deputy faction, it can also include people’s deputies elected in single-mandate districts that had registered as people’s deputy candidates through self-nomination, provided that the work principles of the faction are observed.

The Law presents a new version of Article 59 of the Rules of Procedure, which establishes the terms for creating parliamentary factions (parliamentary groups).

The decision on candidates for the post of the Head of the Verkhovna Rada of Ukraine is made by an open roll call vote (new version of part 5, Article 75 of the Rules of Procedure).

Amendments to part 2, Article 76 of the Rules of Procedure envisage that proposals to recall the Head of the Verkhovna Rada of Ukraine by the Verkhovna Rada of Ukraine (except for recall by personal written request) can be submitted by a minimum of one-third of the people’s deputies in the constitutional membership of the Verkhovna Rada of Ukraine, signed by every one of them (original copies of the signature lists are provided, stating the full name of the people’s deputy, their deputy identification number, and bearing a personal signature which can only be recalled before the issue is included in the meeting agenda of the Verkhovna Rada of Ukraine).

The decision of the Verkhovna Rada of Ukraine to recall the Head of the Verkhovna Rada of Ukraine is made by an open roll call vote, of the majority of people’s deputies from the constitutional membership of the Verkhovna Rada, and recorded in a resolution of the Verkhovna Rada (new version of part 4, Article 77 of the Rules of Procedure).

According to the new version of part 6, Article 208 of the Rules of Procedure, dismissal from the posts of the Head of the Counting Board and the Authorized Human Rights Representative of the Verkhovna Rada is done by written suggestion of the Head of the Verkhovna Rada of Ukraine, provided there are resolutions of appropriate committees.

The issue of casting a vote of non-confidence to the General Prosecutor of Ukraine is included in the meeting agenda of the Verkhovna Rada of Ukraine by suggestion of at least one-third of the people’s deputies in the constitutional membership of the Verkhovna Rada of Ukraine, supported by a vote of over half of the people’s deputies in the constitutional membership of the Verkhovna Rada of Ukraine. Before the issue is included in the meeting agenda of the Verkhovna Rada of Ukraine, signatures of people’s deputies may be recalled (new version of part 2, Article 213 of the Rules of Procedure).
