“On Ratification of the Protocol between the Cabinet of Ministers of Ukraine and the Government of the Republic of Belarus on Amendments and Additions to the Agreement between the Government of Ukraine and the Republic of Belarus on Labor and Social Security of Citizens of Ukraine and the Republic of Belarus Working Outside of Their States”

The Agreement between the Government of Ukraine and the Republic of Belarus on Labor and Social Security of Citizens of Ukraine and the Republic of Belarus Working Outside of Their States was signed on June 17, 1995 in Kyiv, and ratified by the Law of Ukraine N 151/96-VR of April 26, 1996.

The Protocol between the Cabinet of Ministers of Ukraine and the Government of the Republic of Belarus on Amendments and Additions to the Agreement between the Government of Ukraine and the Republic of Belarus on Labor and Social Security of Citizens of Ukraine and the Republic of Belarus Working Outside of Their States (hereinafter referred to as “Protocol”) was signed on September 30, 2010 in Minsk.

The Law ratifies the Protocol.

Amendments to Article 2 of the Agreement between the Government of Ukraine and the Republic of Belarus on Labor and Social Security of Citizens of Ukraine and the Republic of Belarus Working Outside of Their States (hereinafter referred to as “Agreement”), the bodies authorized to represent the Parties in the court of implementing the Agreement (hereinafter referred to as “Authorized Bodies”) are:
  • for the Ukrainian Party – the Ministry of Labor and Social Policy of Ukraine;
  • for the Belarus Party – the Ministry of Internal Affairs of the Republic of Belarus.
The Parties shall inform each other of any changes in the names or list of their Authorized Bodies, through diplomatic channels.

According to the Protocol, to be employed, workers require a work permit of the appropriate Authorized Body of the employing State, issued according to the procedure and on the terms established by the legislation of this state (amendments to Article 3 of the Agreement). A work permit of the appropriate Authorized Body of the employing State is not required for heads of companies, institutions, organizations, whose property, including property complexes, is owned by:
  • for Ukraine – Ukraine, the Cabinet of Ministers of Ukraine, central executive authorities;
  • for the Republic of Belarus – the Republic of Belarus, administrative territorial units.

According to amendments to Article 6 of the Agreement, entry of workers and their family members to the territory of the employing State, their labor, stay, and departure, are carried out according to the national legislation of such state and international agreements that both Party states are members of (previous version – entry of workers and their family members to the territory of the employing State, their labor, stay, and departure, are carried out according to the legislation of such state).
