“On Ratification of the Agreement (in Form of Exchange of Notes) between the Cabinet of Ministers of Ukraine and the Government of the Republic of Estonia on Amendments and Additions to the Agreement between the Cabinet of Ministers of Ukraine and the Government of the Republic of Estonia on Mutual Protection of Secret Information”

The Agreement between the Cabinet of Ministers of Ukraine and the Government of the Republic of Estonia on Mutual Protection of Secret Information was signed in Kyiv on May 10, 2004, and ratified by the Law of Ukraine N 2827-IV of September 7, 2005.

The Agreement (in Form of Exchange of Notes) between the Cabinet of Ministers of Ukraine and the Government of the Republic of Estonia on Amendments and Additions to the Agreement between the Cabinet of Ministers of Ukraine and the Government of the Republic of Estonia on Mutual Protection of Secret Information (hereinafter referred to as “Agreement”) was signed on December 2, 2010 in Kyiv.

The Constitution of Ukraine (Article 85, paragraph 32) states that the Verkhovna Rada of Ukraine provides consent for Ukraine to be bound by international agreements. And, according to Article 9 of the Law of Ukraine "On International Agreements of Ukraine", the Agreement is subject to ratification.

According to Article 3 of the Agreement between the Cabinet of Ministers of Ukraine and the Government of the Republic of Estonia on Mutual Protection of Secret Information, the competent bodies responsible for implementing the Agreement between the Cabinet of Ministers of Ukraine and the Government of the Republic of Estonia on Mutual Protection of Secret Information are:
  • in Ukraine: the Security Service of Ukraine;
  • in Estonia: the National Security Authority, the Department of Security, the Ministry of Defense of the Republic of Estonia.

The Law ratifies the Agreement.

The Agreement envisages amendments to Article 3 of the Agreement between the Cabinet of Ministers of Ukraine and the Government of the Republic of Estonia on Mutual Protection of Secret Information, according to which the competent bodies responsible for implementing the Agreement between the Cabinet of Ministers of Ukraine and the Government of the Republic of Estonia on Mutual Protection of Secret Information in Estonia shall be: the National Security Authority, the Ministry of Defense of the Republic of Estonia.

The Agreement also supplement Article 3 of the Agreement between the Cabinet of Ministers of Ukraine and the Government of the Republic of Estonia on Mutual Protection of Secret Information with a new clause, according to which the Parties shall inform each other of any further changes of their Competent Bodies through diplomatic channels.

The Agreement becomes effective on the day of receipt of the written notification of the Parties that the domestic procedures required for the Agreement to take effect were carried out.
