“On Ratification of the Agreement between the Cabinet of Ministers of Ukraine and the Government of the Russian Federation on the Procedure for Crossing the Ukrainian-Russian State Border by Inhabitants of Near-Border Regions of Ukraine and the Russian Federation”

The Agreement between the Cabinet of Ministers of Ukraine and the Government of the Russian Federation on the Procedure for Crossing the Ukrainian-Russian State Border by Inhabitants of Near-Border Regions of Ukraine and the Russian Federation (hereinafter referred to as “Agreement”) was signed on October 18, 2011 in Donetsk.

The Constitution of Ukraine (Article 85, paragraph 32) states that the Verkhovna Rada of Ukraine provides consent for Ukraine to be bound by international agreements. And, according to Article 9 of the Law of Ukraine "On International Agreements of Ukraine", the Agreement is subject to ratification.

The Law ratifies the Agreement.

According to Article 2 of the Agreement, inhabitants of near-border regions can cross the border using local crossing points listed in Annex 2 of the Agreement, as per their operating regime, and the crossing points provided for by the Agreement between the Government of Ukraine and the Government of the Russian Federation on Crossing Points on the State Border between Ukraine and the Russian Federation of February 8, 1995. Inhabitants of near-border regions can cross the border using local crossing points of the region where they live, and stay on the territory of the adjacent state only within the region which they entered through the local crossing point.

Inhabitants of near-border regions can cross the border on foot, bicycles, motorbikes, animal transport, passenger vehicles, boats owned by them, and interstate public motor and ferry transport used within near-border regions. Inhabitants of near-border regions can move across the border passenger vehicles owned by them and registered on the territory of the home Party without registering them on the territory of the near-border regions of the receiving Party, during a term established by its legislation. Inhabitants of near-border regions can move across the border, through local crossing points, goods that are not intended for manufacturing or other commercial activity, in the amount that does not exceed norms for import (export) of goods established by the legislation of the Party states, without paying customs duties and taxes (Article 4 of the Agreement).

According to Article 5 of the Agreement, inhabitants of near-border regions cross the border according to the terms of the Agreement, on the basis of documents that permit inhabitants of near-border regions to cross the border, as listed in Annex 3 to the Agreement, and that confirm their permanent residence in near-border regions.

Annex 1 to the Agreement establishes the list of near-border regions of Ukraine and the Russian Federation.
