On Seeds and Planting Stock

The present Law outlines basic provisions regulating production, sale and use of seeds and planting stock of agricultural and forest plants, flowers and medicinal herbs, which have been aligned through state standards.
State management in the field of seed and seedling growing is performed by the Cabinet of Ministers of Ukraine, a specially authorized central body of executive power for agrarian policy, a specially authorized central body of executive power for forestry, a specially authorized central body of executive power for housing and communal business and their territorial bodies in accordance with their competence.
The system of seed and seedling growing includes lines of original, elite and reproduction seed and seedling growing, insurance and the State Reserve Seed Fund.
Scientific support to seed and seedling growing is provided by the Ukrainian Academy of Agrarian Sciences, the National Academy of Sciences of Ukraine, other research and development institutions, scientific organizations and natural persons involved in scientific research in the field of seed and seedling growing, as well as scientific organizations and their research departments operating within the system of higher professional education in the sphere in accordance with their competence.
The right to produce and sell original and elite seeds, reproduction seeds and planting stock, hybrids of the first generation is granted to specialized seed and seedling growing farms, farming economies and other subjects of seed and seedling growing upon result of attestation. The Procedure of attestation shall be approved by the specially authorized central body of executive power for agrarian policy of Ukraine.
The Law defines rights and duties of producers of seed and planting stock, the procedure of bringing seed and planting stock in circulation, requirements regarding determination of sort and sowing characteristics of seed and planting stock, import and export of seed and planting stock.
Seeds and planting stock shall be introduced into circulation after they have been recognized by state bodies of management and control in the field of seed and seedling growing, which is confirmed by respective documents of the established form.
Seeds and planting stock are considered recognized if they:
meet requirements of a normative document on purity of variety and sowing qualities;
belong to varieties, which have been included into the Register of Plant Varieties of Ukraine or upon results of state approbation of varieties were recognized as promising and showed significant advantage as to yielding or other valuable qualities.
The Law provides for state support of seed and seedling growing, regulation of seed market, responsibility for violation of legislation in the sphere of seed and seedling growing.
