"On Amendments to the Law of Ukraine "On Licensing Certain Types of Economic Activity" Regarding the Procedure of Issuing a Copy of the License"

The Law of Ukraine "On Licensing Certain Types of Economic Activity" determines the types of economic activity that are subject to licensing, the procedure for their licensing, and establishes state control in the sphere of licensing, and the responsibility of business entities and licensing bodies for violation of legislation in the sphere of licensing.

According to the Law, the place of business subject to licensing that is carried out by a natural person-entrepreneur is a territory or premises that correspond to the requirements of the license conditions and belong to the natural person-entrepreneur on the right of ownership and/or usage (amendments to Article 1 of the Law of Ukraine "On Licensing Certain Types of Economic Activity").

The new version of part 3 of Article 10 of the Law of Ukraine "On Licensing Certain Types of Economic Activity" envisages that if the legal entity applicant has branches or other remote units where the stated activity will be carried out, or if the natural person applicant has places of business, their addresses must be stated in the application.

Copies of the license certified by the licensing body are issued to confirm the licensee's right to carry out the licensed economic activity – to legal entity applicants, one copy per each branch or another remote unit where the respective licensee will be carrying out the economic activity stated in the license, to natural person applicants, one copy per each place of business (new version of part 7 of Article 14 of the Law of Ukraine "On Licensing Certain Types of Economic Activity").

According to the new version of part 9 of Article 14 of the Law of Ukraine "On Licensing Certain Types of Economic Activity", if a legal entity applicant creates a new branch or another remote unit where the economic activity stated in the license will be carried out, or if a natural person applicant creates a new place of business, the licensee must address the licensing body with a standard template application for a copy of the license, accompanied by documents listed in Article 10 of the Law of Ukraine "On Licensing Certain Types of Economic Activity".

The Law also establishes that in case the economic activity stated in the license is no longer carried out at the place for which a copy of the license was issued, the licensee shall notify the licensing body accordingly in writing, within ten business days. The licensing body shall make appropriate changes to the licensing register not later than the business day following the date of receipt of the above notification (new version of part 10 of Article 14 of the Law of Ukraine "On Licensing Certain Types of Economic Activity").
