On Ratification of the Agreement for Cooperation between the Cabinet of Ministers of Ukraine and the European Atomic Energy Community in the Field of Nuclear Safety and the Agreement for Cooperation between the Cabinet of Ministers of Ukraine and the European Atomic Energy Community in the Field of Controlled Nuclear Fusion

The present Law ratifies the Agreement for Cooperation between the Cabinet of Ministers of Ukraine and the European Atomic Energy Community in the Field of Nuclear Safety and the Agreement for Cooperation between the Cabinet of Ministers of Ukraine and the European Atomic Energy Community in the Field of Controlled Nuclear Fusion. Both Agreements were signed in Kyiv on July 23, 1999.

The Agreement for Cooperation between the Cabinet of Ministers of Ukraine and the European Atomic Energy Community in the Field of Nuclear Safety

The purpose of the present Agreement shall be to cooperate in the nuclear sector, inter alia, through the implementation of an agreement on nuclear safety, raising nuclear safety and apply internationally accepted nuclear safety principles and guidelines.

Cooperation under the present Agreement shall be for peaceful purposes only and shall be conducted on the basis of mutual benefit. Cooperation shall be as broad as possible and involve the following areas:
reactor and development on safeguards of nuclear materials;
radiation protection;
nuclear waste management;
decommissioning, decontaminating and dismantling of nuclear installations;
prevention of illicit trafficking of nuclear materials.

The cooperation shall be implemented in particular through:
- exchange of technical information;
- exchange of personnel between laboratories and/or organizations (enterprises, institutions) involved on both sides, including for training purposes;
- exchange of samples, materials, instruments, and apparatus for experimental purposes.

All costs resulting from such cooperation shall be borne by the Party that incurs them. A Coordinating Committee consisting of members appointed in equal number by the two Parties shall be established to supervise the implementation of the present Agreement.

The present Agreement shall remain in force for an initial period of 10 years. Thereafter, this Agreement shall be automatically renewed for five-year periods. The present Agreement may be terminated at any time by either Party upon six month's written notice prior to its expiry date.

The Agreement includes Annexes that identify:
Guiding Principles on the Allocation of Intellectual Property Rights Resulting from Joint Research Under the Present Agreement (Annex 1);
Definitions (Annex 2);
Indicative Features of a Technology Management Plan (TMP) (Annex 3).

The Agreement for Cooperation between the Cabinet of Ministers of Ukraine and the European Atomic Energy Community in the Field of Controlled Nuclear Fusion

The purpose of the present Agreement shall be to cooperate in the nuclear sector, inter alia, through the implementation of an agreement on thermonuclear fusion, and to facilitate the achievement of thermonuclear fusion energy.

Cooperation under this Agreement may be undertaken in the following areas:
experimental and theoretical studies of plasma confinement, transport, heating and current drive;
studies in plasma theory;
thermonuclear fusion technology;
applied plasma physics.

The cooperation shall be implemented in particular through:
- exchange of technical information;
- exchange of personnel between laboratories and/or organizations (enterprises, institutions) involved on both sides, including for training purposes;
- exchange of samples, materials, instruments, and apparatus for experimental purposes.

The Parties shall establish a Coordinating Committee to coordinate and to supervise the implementation of the present Agreement.

The present Agreement shall remain in force for an initial period of 10 years. Thereafter, this Agreement shall be automatically renewed for five-year periods. The present Agreement may be terminated at any time by either Party upon six month's written notice prior to its expiry date.

The Agreement includes Annexes that identify:
