“On Ratification of the Agreement between the Cabinet of Ministers of Ukraine and the Government of the Russian Federation on Cooperation for Prevention of Emergencies and Fires, and Liquidation of Their Consequences in Population Centers Housing Installations of the Russian Federation Black Sea Fleet on the Territory of Ukraine”

The Agreement between the Cabinet of Ministers of Ukraine and the Government of the Russian Federation on Cooperation for Prevention of Emergencies and Fires, and Liquidation of Their Consequences in Population Centers Housing Installations of the Russian Federation Black Sea Fleet on the Territory of Ukraine (hereinafter referred to as “Agreement”) was signed on July 12, 2012 in Yalta.

This Law ratifies the Agreement.

Article 1 of the Agreement provides definitions of terms used in it.

According to Article 2 of the Agreement, the Parties appoint the following as competent authorities for the purposes of the Agreement implementation:
  • on the Ukrainian Side – the Ministry of Emergencies of Ukraine and the Ministry of Defense of Ukraine;
  • on the Russian side – the Ministry of Defense of the Russian Federation.

Article 3 of the Agreement envisages that cooperation under the Agreement is carried out in the following directions:
  • timely exchange of information about the threat or occurrence of emergencies or fires in population centers housing installations of the Russian Federation Black Sea fleet on the territory of Ukraine;
  • carrying out joint measures and providing the necessary assistance in liquidation and minimization of the consequences of emergencies or fires;
  • exchange of experience in preventing emergencies and fires, and liquidating their consequences;
  • evaluating the possible impact of emergencies and fires on the natural environment and public health;
  • organizing and holding joint training in the issues of preventing emergency situations and fires, and liquidating their consequences;
  • developing an early warning system for emergencies and fires that pose a threat to public health.

The competent authorities of the Parties shall timely inform each other about any threats or actual occurrences of emergencies or fires, and organize for cooperation aimed at their prevention or liquidation of their consequences. In case an emergency or a fire occurs, the competent authority of one Party supplies the competent body of the other Party with information about the nature of emergency or fire, their scale, degree of threat, and other information required for a timely assessment of the situation and to determine the forces and means necessary to localize and liquidate its consequences (Article 4 of the Agreement).

According to Article 5 of the Agreement, military servicemen of the Russian Federation Black Sea fleet military units located on the territory of Ukraine, which are included in emergency rescue units, are subject to the legislation of the Russian Federation, during the time of their participation in measures to prevent or liquidate the consequences of emergencies and fires in population centers housing installments of the Russian Federation Black Sea fleet. Persons included in the Ukrainian emergency rescue units, during the time of their participation in measures to prevent or liquidate the consequences of emergencies and fires in population centers housing installments of the Russian Federation Black Sea fleet, are subject to the legislation of Ukraine.

In case of an emergency or a fire at the location of an installment of the Russian Federation Black Sea fleet in Ukraine, assistance is provided following the official address of the Russian Party, by immediate dispatch of the Ukrainian Party emergency rescue units to the place of emergency or fire, in order to rescue people and material valuables, restore normal living conditions, and protect the environment (Article 6 of the Agreement).

Article 7 of the Agreement envisages that in case of an emergency or a fire, assistance is provided following the official address of the Ukrainian Party, by immediate dispatch of the Russian Party emergency rescue units to the place of emergency or fire, in order to rescue people and material valuables, restore normal living conditions, and protect the environment. Material and technical support of the Russian Party emergency rescue units must be sufficient for autonomous on-site operation for a minimum of 72 hours. The Ukrainian Party supplies these emergency rescue units with everything required for their further work, including accommodation, catering and medical aid.

According to Article 8 of the Agreement, the Ukrainian Party provides for unhampered transit to the place of emergency, for vehicles, equipment and persons included in the Russian Party emergency rescue units located on the territory of Ukraine, as well as their return to their dislocation.

Unless otherwise agreed by the Parties, assistance under the Agreement is provided free of charge (Article 9 of the Agreement).

The objective of the Law is to establish the general principles of cooperation between Ukraine and Russia in the sphere of preventing and liquidating the consequences of emergencies, and the procedures for providing coordinated mutual assistance in case of an emergency on the territory of Ukraine.
