“On Adopting the National Social Program for Improvement of Safety, Workplace Hygiene and Production Environment in 2014 - 2018”

The Law adopts the National Social Program for Improvement of Safety, Workplace Hygiene and Production Environment in 2014 - 2018 (hereinafter referred to as “Program”).

The objective of the Program is comprehensive problem-solving in the sphere of workplace safety, creating a contemporary safe and healthy production environment, minimizing the rate of workplace injuries, occupational diseases and industrial accidents, in order to facilitate sustainable economic development and social orientation, and preserve and develop the labor potential of Ukraine. The following ways of problem-solving in the sphere of workplace safety are suggested:
  • increasing the effectiveness of state management of workplace safety, namely, by harmonizing the normative legal base in the sphere of workplace safety with the current EU requirements and legislation;
  • improving the system for state supervision and community control over adherence to the requirements of workplace safety legislation, optimizing the work of workplace safety units of central and local bodies of executive power and bodies of local self-government;
  • improving the system of state management of workplace safety by reforming the state bodies of workplace safety management;
  • monitoring the development, implementation and functioning of workplace safety management systems at the state, industrial and regional levels, namely by implementing professional and industrial risk management principles;
  • deregulating business activity by simplifying the permit system in the sphere of workplace safety and implementing the declaratory principle of supervision of workplace and industrial safety;
  • developing and implementing the mechanism of economic incentives for employers depending on the safety level, accident and occupational disease rate, and the actual state of workplace safety;
  • increasing the level of employer responsibility for creating safe and healthy work conditions, and for timely reporting of the workplace safety state;
  • improving the system for recording and analyzing data about industrial accidents and occupational diseases;
  • improving the mechanism for discovering concealed industrial accidents and occupational diseases;
  • developing and implementing innovative technologies, new means for individual and collective protection using modern materials and scientific research in the sphere of workplace safety;
  • restoring and modernizing medical departments at industrial facilities, including those with severe, harmful and hazardous work conditions, ensuring development of the system for medical and sanitary aid for employees, developing and improving methods for diagnostics, prevention and treatment of occupational diseases;
  • developing state requirements to the system for training, retraining and advanced training for workplace safety staff;
  • developing and implementing modern technologies, innovative training methods, industrial education standards, publishing education programs, textbook, handbooks, methodical and illustrated materials, and electronic educational aids, aimed to improve the system for training professionals in the sphere of workplace safety, particularly those that carry out work associated with increased risk, and work requiring professional selection;
  • developing and implementing the model for the workplace safety workshop for small and medium entrepreneurs, carried out during their state registration;
  • expanding the system for informational support of the community in the issues of workplace safety;
  • increasing the level of workplace safety culture by promoting workplace safety and means of preventing workplace injuries, occupational diseases and industrial accidents, forming a responsible attitude of employees towards personal safety and safety of others, as well as towards the industrial and natural environment;
  • increasing the level of scientific and technical research into the state of workplace safety, resolving issues related to prevention of workplace injuries and occupational diseases, coordinating scientific and technical work in this sphere, and ensuring practical implementation of the positive results of such work;
  • using the progressive local and foreign experience in the issues of improving workplace conditions and safety, through international cooperation.

Implementing the Program will allow:
  • creating a contemporary safe and healthy industrial environment;
  • minimizing the risk of workplace injuries, occupational diseases and industrial accidents;
  • by 2018, decreasing the rate of workplace injury and the rate of workplace injury with a lethal outcome to 0.6 and 0.033, respectively;
  • preserving the health and lives of 850 and 270 employees, respectively;
  • decreasing the amount of social and economic losses from the negative industrial occurrences;
  • ensuring sustainable development of the national economy.

The Program events are financed within the expenses allocated in the state budget to the State Service of Ukraine for Mining Supervision and Industrial Safety, the Ministry of Internal Affairs of Ukraine, the Ministry of Agrarian Policy and Food of Ukraine, the Ministry of Energy and Coal Industry of Ukraine, the Ministry of Environment and Natural Resources of Ukraine, the Ministry of Health Care of Ukraine, the State Service of Ukraine for Geology and Mineral Resources of Ukraine, and the National Academy of Medical Sciences of Ukraine; as well as at the expense of the Fund of Social Insurance against Workplace Injuries and Occupational Diseases, and other sources. The forecasted amount of financing for the Program is UAH 221.88 million, of which UAH 101.16 million from the state budget, UAH 120.32 million from the Fund of Social Insurance against Workplace Injuries and Occupational Diseases, and UAH 0.4 million from other sources.

Annexes to the Program provide for:
  • Program summary;
  • Program tasks and events;
  • expected results of the Program implementation.

The Law aims to provide for comprehensive problem-solving in the sphere of workplace safety, create a contemporary safe and healthy production environment, minimize the rate of workplace injuries, occupational diseases and industrial accidents, in order to facilitate sustainable economic development and social orientation, and preserve and develop the labor potential of Ukraine.
