"On Amendments to the Law of Ukraine "On Ensuring Civil Rights and Freedoms, and the Legal Regime on the Temporarily Occupied Territory of Ukraine" Relating to the Place of Temporary Residence and the Right to Education"

The Law of Ukraine "On Ensuring Civil Rights and Freedoms, and the Legal Regime on the Temporarily Occupied Territory of Ukraine" determines the status of the territory of Ukraine temporarily occupied as a result of armed aggression of the Russian Federation, establishes a special legal regime on that territory, determines the work specifics of state authorities, bodies of local self-government, companies, institutions and organizations under this regime, observance and protection of human and civil rights and freedoms, and the rights and lawful interests of legal entities.

Article 6 of the Law of Ukraine "On Ensuring Civil Rights and Freedoms, and the Legal Regime on the Temporarily Occupied Territory of Ukraine" provides for the right of citizens residing on the temporarily occupier territory or relocated from it, to receive documents that confirm their Ukrainian citizenship, identify their person, or confirm their special status.

The Law supplements Article 6 of the Law of Ukraine "On Ensuring Civil Rights and Freedoms, and the Legal Regime on the Temporarily Occupied Territory of Ukraine" with a new part, which establishes the following:
  • by request of citizens of Ukraine who reside on the temporarily occupied territory or relocated from it, proof of place of temporary residence certificates are drawn up and issued by their local executive authority that implements state policy in the sphere of migration (immigration and emigration), including counteracting illegal (unlawful) migration, citizenship, and registration of natural persons, refugees, and other migrant categories determined by the legislation. Such certificates are issued to citizens on the day of request, on the basis of a passport of a citizen of Ukraine or another document that, according to the Law of Ukraine "On Freedom of Movement and Free Choice of Place of Residence in Ukraine", contains information about registration of place of residence, and a written application stating the address at which the citizen can be served official correspondence. Information (note) of the place of temporary residence of such person is not entered into their passport;
  • the form and issue procedure of the place of temporary residence certificate, and the form of written application submitted by the citizen to receive the certificate are approved by the local executive authority that implements state policy in the sphere of migration (immigration and emigration), including counteracting illegal (unlawful) migration, citizenship, and registration of natural persons, refugees, and other migrant categories determined by the legislation.

Ensuring exercise of the rights of citizens who reside on the temporarily occupied territory or relocated from it, to employment, pension benefits, mandatory state social insurance, social services, and education are provided for by Article 7 of the Law of Ukraine "On Ensuring Civil Rights and Freedoms, and the Legal Regime on the Temporarily Occupied Territory of Ukraine".

The Law also presents a new version of Article 7, part 12 of the Law of Ukraine "On Ensuring Civil Rights and Freedoms, and the Legal Regime on the Temporarily Occupied Territory of Ukraine", according to which:
  • citizens of Ukraine who reside on the temporarily occupied territory or relocated from it have the right to pursue or continue pursuing a certain education level on the territory of other regions of Ukraine, at the expense of the state budget, and be granted accommodation in dormitories for the period of education;
  • the above citizens of Ukraine have the right to pursue a certain education level, at the expense of budget funds, in state-owned and municipal-owned institutions, according to the terms of enrolment to higher educational institutions for the respective year, approved by the central executive authority that provides for creation of state policy in the spheres of education and science;
  • if such persons were not included into the list of persons recommended by the higher educational institution for enrolment to state ordered student spaces, the central executive authority whose management sphere includes the educational institution, by petition of the higher educational institution, shall provide (allocate) additional state ordered student spaces, with regard to the education major selected by the enrollee, and according to the procedure established by the Cabinet of Ministers of Ukraine.
