On Amendments to the Code on Administrative Offences of Ukraine,
the Criminal Code of Ukraine and the Criminal Procedural Code of Ukraine
Regarding the Responsibility for Violating the Rules of Radiation Safety

The present Law shall introduce amendments to Article 42-2 Stocking, Processing or Sale of Radioactively Contaminated Food Products or Other Products of the Code on Administrative Offences of Ukraine. According to these amendments, administrative responsibility shall be envisaged for stocking, processing for the purpose of sale or selling food products or other products that were radioactively contaminated above the allowed levels, provided there are no indications of an act set forth by the Criminal Code of Ukraine. These particular offences shall entail the imposition of a fine:
  • on individuals from eight to twenty-five minimum tax-free personal incomes with confiscation of the above-mentioned products or without such confiscation;
  • on officials from fifteen to fifty minimum tax-free personal incomes with confiscation of the above-mentioned products or without such confiscation.

Violation of the requirements of the radiation safety regime in a specially determined radioactive contamination zone that manifests itself through penetration into this zone without a permit of the relevant bodies or settling without authorization in this zone, or destruction, damage to or transfer of the signs of radioactive contamination or the fence of the above-mentioned zone shall entail the imposition of a fine:
  • on individuals from twenty to thirty minimum tax-free personal incomes with confiscation of the instruments that were used for committing the relevant offence;
  • on officials from twenty-five to thirty minimum tax-free personal incomes with confiscation of the instruments that were used for committing the relevant offence.

The present Law shall supplement the Criminal Code of Ukraine with a new Article 267-1. Part 1 of Article 267-1 of the Criminal Code of Ukraine shall establish that criminal responsibility shall be envisaged for moving in any manner beyond the borders of the estrangement zone or the zone of unconditional (mandatory) expulsion without the receipt of a permit established by the law or carrying out dosimetric control of foods products of vegetable and animal origin, industrial or other products, fish, plants, or any other objects. Specifically, such responsibility shall take form of the imposition of a fine from fifty to eighty minimum tax-free personal incomes or the restraint of liberty for a period from one to three years or the imprisonment for the same period.

Purchase of objects identified in part 1 of Article 267-1 of the Criminal Code of Ukraine for the purpose of utilization or sale, if the fact of their origin from the estrangement zone or the zone of unconditional (mandatory) expulsion has been known to the guilty individual in advance, shall be punished with a fine from seventy to eighty-five minimum tax-free personal incomes or the restraint of liberty for a period from two to four years or the imprisonment for the same period.

Pre-trial investigation in cases related to crimes specified in the new Article 267-1 of the Criminal Code of Ukraine shall be carried out by investigators of bodies of internal affairs.
