“On Amendments to the Criminal and Criminal Procedural Codes
of Ukraine Regarding the Use of Children for Panhandling’”

The present Law shall supplement the Criminal Code of Ukraine with a new Article 150-1. According to this new Article, the use of a minor child by parents or individuals substituting for them for practicing panhandling (regular begging for money, objects or other tangible values from strangers) for the purpose of receiving profits shall be punished with the restraint of liberty for the period of up to three years or imprisonment for the same period. If such actions are committed with respect to somebody else’s minor child or are connected with violence or the threat of violence, as well as if such actions are committed repeatedly or by an individual who has earlier committed one of the crimes specified by Articles 150, 303 or 304 of the Criminal Code of Ukraine, or by a previous concert of a group of individuals, they shall be punished with the restraint of liberty for the period of up to five years or imprisonment for the period from three to eight years. If the above-mentioned actions are committed by an organized group and also if such actions resulted in causing grave bodily injuries or bodily injuries of medium gravity to such a child, they shall be punished with imprisonment for the period from five to ten years.
According to the present Law, pre-trial investigation in cases on crimes specified above shall be carried out by investigation officer of bodies of internal affairs (amendments to part 2 of Article 112 of the Criminal Procedural Code of Ukraine).
