"On Amendments to the Rules of Procedure of the Verkhovna Rada of Ukraine Regarding Preliminary Review of Law Drafts and Drafts of Other Acts by Committees"

The Rules of Procedure of the Verkhovna Rada of Ukraine were adopted by the Law of Ukraine "On the Rules of Procedure of the Verkhovna Rada of Ukraine" N1861-VI of February 10, 2010.

The operating procedures of the Verkhovna Rada of Ukraine, its bodies and officials, its principles of establishment, organization of activities and dissolution of parliamentary factions (deputy groups) of the Verkhovna Rada of Ukraine shall be regulated by the Constitution of Ukraine, the Rules of Procedure of the Verkhovna Rada of Ukraine, and the Laws of Ukraine "On Committees of the Verkhovna Rada of Ukraine", "On Status of People's Deputy of Ukraine", and "On Interim Investigating Commissions, a Special Interim Investigating Commission and Special Interim Commissions of the Verkhovna Rada of Ukraine" (Article 1 of the Rules of Procedure of the Verkhovna Rada of Ukraine).

The procedure for preliminary review of law drafts and drafts of other acts by parliamentary committees is established by Article 93 of the Rules of Procedure of the Verkhovna Rada of Ukraine.

The Law presents new versions of Article 93, parts 1 and 3, of the Rules of Procedure of the Verkhovna Rada of Ukraine, which envisage the following:
  • each law draft or draft of another act, no later than five days after its registration, shall be forwarded by the Head of the Verkhovna Rada of Ukraine, or, according to the distribution of duties, the First Deputy or a deputy Head of the Verkhovna Rada of Ukraine, to the committee that, according to the competence of the committees, is determined as the chief committee for preparation and preliminary review of a law draft or a draft of another act; as well as to the committee whose competence includes the budget issues, for expert analysis of the impact of such draft on the budget indicators and of its compliance to the laws regulating budget relations; to the committee whose competence includes issues of counteracting corruption, to prepare an expert opinion on compliance of such draft to the requirements of the anti-corruption legislation; and to the committee whose competence includes assessing the compliance of law drafts to international legal obligations of Ukraine in the sphere of European integration, to prepare an expert opinion. The committee whose competence includes budget issues shall forward each law draft to the Cabinet of Ministers of Ukraine, within three days, for expert analysis of the draft's impact on budget indicators and of its compliance to the laws that regulate budget relations;
  • the chief committee, no later than within thirty days, shall conduct a preliminary review of the law draft or draft of another law, and adopt a conclusion as to whether the draft should be included in the agenda of the Verkhovna Rada of Ukraine session. Attached to the conclusion of the chief committee shall be conclusions of committees whose competence includes issues of budget, counteracting corruption, and analysis of compliance of law drafts to international legal obligations of Ukraine in the sphere of European integration, respectively, which shall be submitted to the chief committee within 21 days after the law draft or draft of another act was received for analysis.

The Law supplemented Article 93 of the Rules of Procedure of the Verkhovna Rada of Ukraine with a new part, which establishes the following:
  • by instruction of the Verkhovna Rada of Ukraine, the Head of the Verkhovna Rada of Ukraine, by address of the head of a committee, head or first deputy head of the chief committee, or by its own initiative, a committee whose competence includes the issues of rules of procedure, shall reviews a law draft or draft of another act, and prepare an expert opinion on whether its execution and registration comply to the requirements of law, the Rules of Procedure of the Verkhovna Rada of Ukraine, and normative legal acts adopted according to them;
  • the conclusion of the committee whose competence includes the issues of rules of procedure shall be attached to the conclusion of the chief committee, and must be submitted to the chief committee within 21 days after the law draft or draft of another act was received for analysis. If a law draft or draft of another act was executed and/or registered with violations of the requirements of the law, the Rules of Procedure of the Verkhovna Rada of Ukraine or normative legal acts adopted according to them, the conclusion of the committee whose competence includes the issues of rules of procedure shall be forwarded to the chief committee and the Head of the Verkhovna Rada of Ukraine, to return the law draft or draft of another act to the initiating entity, without being included in the agenda of a Verkhovna Rada of Ukraine plenary session or reviewed at such a plenary session.

The Law also introduces appropriate amendments to Article 145 of the Rules of Procedure of the Verkhovna Rada of Ukraine, which determines the preparation procedure for reviewing the issue of including a law draft on amendment of the Constitution of Ukraine in the agenda of a Verkhovna Rada of Ukraine session, and the procedure for continuing work on such law draft.
