On Legal Status of Foreigners and Stateless Persons

The Law of Ukraine On Legal Status of Foreigners and Stateless Persons, hereinafter the Law, defines legal status, secures basic rights, freedoms and duties of foreigners and stateless persons who reside or temporarily stay in Ukraine.

Foreigners and stateless persons may, according to the set procedure, immigrate to Ukraine for permanent residence or arrive for employment for a fixed term, as well as stay on its territory temporarily. While staying on the territory of Ukraine they shall enjoy the same rights and freedoms and execute the same duties as the Ukrainian citizens, except for some limits set by the legislation of Ukraine and norms of the international agreements approved by Ukraine. 

Foreigners and stateless persons may be given asylum or refugee status in Ukraine.

Foreigners and stateless persons shall have equal with Ukrainian citizens rights to:
  • Perform investment and entrepreneurial activity;
  • labor activity;
  • rest;
  • health protection;
  • accommodation (on condition of permanent residence on the territory of Ukraine);
  • education;
  • liberty of conscience;
  • get marriage;
  • free departure from the territory of Ukraine.
Some exceptions from this provision are set by provisions of the legislation of Ukraine.

The questions concerning granting to the foreigners and stateless persons the right to social protection, participation in associations of citizens and taxation of their incomes shall be solved according to the legislation of Ukraine and international agreements of Ukraine.

Foreigners and stateless persons may enter Ukraine by valid passport documents. Thereto, foreigners and stateless persons shall get entry visa in a set procedure, if otherwise is not stipulated by the legislation of Ukraine and international agreements of Ukraine.

The foreigners and stateless persons who committed crime, administrative or other violation of the law shall bear responsibility equally with Ukrainian citizens. This norm shall not apply to the staff of diplomatic representative offices and employees of consular posts of foreign states in Ukraine, as well as to other persons defined by the international agreements of Ukraine.

For violation by a foreigner or a stateless person of the legislation of Ukraine the following measures may be applied to him:
  • shortening of the defined term of stay in Ukraine;
  • deportation outside the territory of Ukraine.
