"On Amendments to the Law of Ukraine "On Telecommunications"

The Law of Ukraine "On Telecommunications" establishes the legal grounds for activity in the sphere of telecommunications and determines the authority of the state in managing and regulating the above activity, as well as the rights, obligations and principles of liability of natural persons and legal entities that take part in this activity or use telecommunication services.

Articles 38 and 39 of the Law of Ukraine "On Telecommunications" determine the rights and obligations of telecommunication operators and providers.

According to part 2, Article 38 of the Law of Ukraine "On Telecommunications", switching off of end user equipment of divisions of the Ministry of Defense of Ukraine, the Security Service of Ukraine, the Foreign Intelligence Service of Ukraine, the State Service of Special Communication and Information Protection of Ukraine, the Ministry of Internal Affairs of Ukraine, the specially authorized central executive power body for emergencies and affairs in protection of population from the consequences of the Chernobyl catastrophe, specially authorized central body of executive power in the issues of state border protection, and of communication lines of emergency call services is carried out according to the procedure established by the Cabinet of Ministers of Ukraine.

According to clause 9, part 1, Article 39 of the Law of Ukraine "On Telecommunications", telecommunication operators shall provide telecommunication services on a top priority basis, among others, to divisions of the Ministry of Defense of Ukraine, the Security Service of Ukraine, the Foreign Intelligence Service of Ukraine, the State Service of Special Communication and Information Protection of Ukraine, the Ministry of Internal Affairs of Ukraine, the specially authorized central executive power body for emergencies and affairs in protection of population from the consequences of the Chernobyl catastrophe, specially authorized central body of executive power in the issues of state border protection.

The Law amends part 2, Article 38 of the Law of Ukraine "On Telecommunications", according to which switching off of end user equipment of divisions of the central body of executive power in the customs issues is carried out according to the procedure established by the Cabinet of Ministers of Ukraine.

According to the Law, telecommunication operators shall provide telecommunication services on a top priority basis, among others, to divisions of the central body of executive power in the customs issues (amendments to clause 9, part 1, Article 39 of the Law of Ukraine "On Telecommunications").
