On Motor Roads

This Law determines the principles for ensuring functioning of motor roads, their building, reconstruction, repair and maintenance for the sake of the state and users of motor roads. It applies to the relations connected with the functioning and development of motor roads regardless of their assignment and ownership forms.

The state policy and development strategy of all motor roads on the territory of Ukraine are conducted by the central body of executive power in the field of transport.

Motor roads are subdivided into the following types:
  • motor roads of general use;
  • streets and roads of cities and other inhabited localities;
  • departmental (technological) motor roads;
  • motor roads on private territories.

Motor roads of general use are state-owned and shall not be subject to privatization. State management of motor roads of general use is conducted by the State Service of Motor Roads of Ukraine.

Motor roads of general use are subdivided into:
  • motor roads of state significance (subdivided into international, national, regional);
  • motor roads of local significance (are subdivided into territorial, oblast and district).

Motor roads of general use may be given into concession. Functions of the concession issuer are perfumed by the body of state management of motor roads of general use (the State Service of Motor Roads of Ukraine).

Streets and roads of cities and other inhabited localities are managed by the bodies of local self-government and belong to communal property. Streets, roads of cities and other inhabited localities are managed by the respective bodies of local self-government that are in charge of them.

Streets and roads of cities and other inhabited localities are subdivided into:
  • highways (continuous traffic and regulated traffic);
  • highway streets of all-city significance (continuous traffic and regulated traffic);
  • highway streets of district significance;
  • streets and roads of local significance.

Streets and roads of cities and other inhabited localities may be transferred into state ownership free of charge upon the decision of respective bodies of local self-government and the Cabinet of Ministers of Ukraine.

To the departmental (technological) motor roads belong internal economic technological roads owned by legal entities or natural persons.

Departmental (technological) motor roads are managed and developed by legal entities or natural persons that own them.

To the motor roads on private territories belong motor roads located on the territories owned by legal (non-state) entities or natural persons.

Motor roads on private territories may be transferred into state or communal ownership by the owners of private territories upon the decision of the Cabinet of Ministers of Ukraine or bodies of local self-government respectively. A motor road of general use may be paid all over its length and on its separate parts.

Motor roads of general use are referred to paid ones only provided that:
  • they are improved sufficiently;
  • alternative passage of transport vehicles by free of charge motor roads is ensured.

Paid motor roads of general use shall remain state-owned and shall not be subject to privatization. No actions, resulting in the alienation of roads from the state property, may be committed as regards to them.

Fare for driving along paid motor roads of general use shall be taken from all transport vehicles that drive along such roads. Maximum amount of fare and procedure for its levy are set by the Cabinet of Ministers of Ukraine. The fare shall be directed to the State Budget of Ukraine.
