"On the Cabinet of Ministers of Ukraine"

The present Law determines the organization, authority and the procedure for operation of the Cabinet of Ministers of Ukraine.

According to Article 1 of the Law, the Cabinet of Ministers of Ukraine (the Government of Ukraine) is the supreme body in the system executive power bodies.

The Cabinet of Ministers of Ukraine exercises executive power directly and through ministries, other central bodies of executive power, the Council of Ministers of the Autonomous Republic of Crimea, and local state administrations, as well as directs and coordinates the work of these bodies.

The work of the Cabinet of Ministers of Ukraine is based on the principles of the supremacy of law, lawfulness, division of state power, continuity, collegiality, solidary responsibility, openness and transparency (Article 3 of the Law).

Article 6 of the Law establishes that the Cabinet of Ministers of Ukraine consists of the Prime Minister of Ukraine, the First Vice Prime Minister of Ukraine, three vice prime ministers, and ministers of Ukraine.

The positions of the members of the Cabinet of Ministers of Ukraine belong to political offices that shall not be subject to the labor legislation and the legislation on civil service.

According to Article 8 of the Law, the Prime Minister of Ukraine is appointed by the President of Ukraine by consent of over half of the constitutional membership of the Verkhovna Rada of Ukraine.

Members of the Cabinet of Ministers of Ukraine, except for the Prime Minister of Ukraine, are appointed by the President of Ukraine by recommendation of the Prime Minister of Ukraine (Article 9 of the Law).

According to Article 11 of the Law, the Cabinet of Ministers of Ukraine steps down before the newly elected President of Ukraine.

The resignation of the Cabinet of Ministers of Ukraine is accepted by the President of Ukraine.

Article 18 of the Law envisages that a member of the Cabinet of Ministers of Ukraine (except the Prime Minister of Ukraine) can be dismissed from their post by the President of Ukraine:
  • by decision of the President of Ukraine;
  • by accepting the resignation of a member of the Cabinet of Ministers of Ukraine based on the resignation application submitted by them.

The decision of the President of Ukraine to dismiss a member of the Cabinet of Ministers of Ukraine from their post is made in the form of an order of the President of Ukraine.

Article 20 of the Law determines the list of the main authorities of the Cabinet of Ministers of Ukraine.

The Cabinet of Ministers of Ukraine reports to the President of Ukraine (Article 25 of the Law).

Article 27 of the Law envisages that the Cabinet of Ministers of Ukraine holds the right of legislative initiative in the Verkhovna Rada of Ukraine. The Cabinet of Ministers of Ukraine introduces bills to be reviewed by the Verkhovna Rada of Ukraine.

According to Article 25 of the Law, on the days of the plenary sessions of the Verkhovna Rada of Ukraine, every week, an hour is allocated for questions for the members of the Cabinet of Ministers of Ukraine. The entire Cabinet of Ministers of Ukraine, except for the members that cannot be present for valid reasons, takes part in the "An Hour of Questions for the Government" in the Verkhovna Rada of Ukraine.

According to Article 45 of the Law, the members of the Cabinet of Ministers of Ukraine bear solidary responsibility for the work results of the Cabinet of Ministers of Ukraine as a collegial body of executive power. The members of the Cabinet of Ministers of Ukraine are personally liable for the state of affairs in the spheres of state management assigned to them.

Article 50 of the Law envisages that the Cabinet of Ministers of Ukraine issues compulsory acts resolutions and instructions. Normative acts of the Cabinet of Ministers of Ukraine are issued in the form of resolutions of the Cabinet of Ministers of Ukraine. Acts of the Cabinet of Ministers of Ukraine in the organizational and management issues, as well as other current issues, are issued in the form of instruction of the Cabinet of Ministers of Ukraine.

Resolutions of the Cabinet of Ministers of Ukraine, apart from resolutions containing restricted information, take effect on the day of their official publication.
