“On Ratification of the Agreement between the Government of Ukraine and the International Federation of Red Cross and Red Crescent Societies on Cooperation and Legal Status of the International Federation’s Office in Kyiv”

The Agreement between the Government of Ukraine and the International Federation of Red Cross and Red Crescent Societies on Cooperation and Legal Status of the International Federation’s Office in Kyiv (hereinafter referred to as “Agreement”) was signed on February 6, 1997 in Geneva.

The Law ratifies the Agreement.

According to Article 1 of the Agreement, the Government of Ukraine recognizes the international legal personality of the International Federation of Red Cross and Red Crescent Societies (hereinafter referred to as “International Federation”). To implement its functions and achieve its set objective, the International Federation shall have a legal entity status on the territory of Ukraine, with full legal capacity to conclude contracts, assume title of and manage immovable and movable property, and initiate court proceedings.

Through its office in Kyiv, the International Federation will work throughout the territory of Ukraine to fulfill its humanitarian mission, as per its Charter and the foundational principles of the International Red Cross and Red Crescent Movement (Article 2 of the Agreement).

The work methods of the International Federation’s office in Kyiv are determined by Article 3 of the Agreement.

The International Federation’s office in Kyiv, its property and funds, regardless of their location and management, are guaranteed protection from all forms of court claims, except for cases when they explicitly waive such immunity. The property and funds of the office are not subject to search, requisition, confiscation, expropriation and any other form of executive, administrative and judicial intervention. The premises and all documents of the representative office are inviolable (Article 4 of the Agreement).

According to Article 5 of the Agreement, the International Federation’s Office in Kyiv can possess funds in hryvnya and foreign currencies. The office is guaranteed freedom of financial operations.

Tax privileges for the International Federation’s Office in Kyiv are established by Article 6 of the Agreement.

Article 7 of the Agreement establishes freedom of communication of the International Federation’s office in Kyiv.

According to Article 8 of the Agreement, the following officials are members of the International Federation’s office in Kyiv:
  • the Head of the Office – appointed by the General Secretary of the International Federation;
  • representatives – appointed by the General Secretary of the International Federation;
  • administrative and technical personnel – appointed by the General Secretary of the International Federation or employed by the office from among citizens of Ukraine.

The status of members of the International Federation’s office in Kyiv and of the International Federation’s representatives is determined by Articles 9 and 10 of the Agreement.

Article 11 of the Agreement entail the conditions of waiving privileges and immunities of the International Federation’s office in Kyiv and the International Federation’s representatives.

The Government of Ukraine shall assist in the purchase and use of appropriate office premises for the International Federation’s office in Kyiv, as well as appropriate residential premises for its members (Article 12 of the Agreement).
