On Protection of Cultural Heritage

The Law regulates legal, organizational, social and economic relations in the sphere of protection of cultural heritage for its saving, use of objects of cultural heritage in public life, protection of traditional nature of environment for the sake of present and future generations. The objects of cultural heritage, which are located on the territory of Ukraine, are protected by the state.

The objects of cultural heritage shall be divided:
1. By types into:
- constructions (works);
- complexes (ensembles);
- remarkable places;
2. By kinds into:
- archaeological;
- historical;
- monumental arts;
- architecture and town-planning;
- garden park arts;
- landscape.

State management in the sphere of protection of cultural heritage shall be conducted by the Cabinet of Ministers of Ukraine and the specially authorized bodies for protection of cultural heritage:
- the central body of executive power in the sphere of cultural heritage protection;
- the body for protection of cultural heritage of the Council of Ministers of the Autonomous Republic of Crimea;
- the bodies for protection of cultural heritage of oblast, Kyiv and Sevastopol city, district state administrations;
- the bodies of local self-government for protection of cultural heritage.

The Law determines authorities of the Cabinet of Ministers of Ukraine, the central body of executive power, other bodies for protection of cultural heritage in the sphere of protection of cultural heritage.

The objects of cultural heritage regardless of ownership form shall be registered in the State Register of Immovable Monuments of Ukraine according to the categories of national and local significance of the monument. Record of an object of cultural heritage into the Register and introduction of changes thereto (exclusion from Register, change of category of the monument) shall be conducted according to the category of the monument:
a) monuments of national significance by the resolution of the Cabinet of Ministers of Ukraine upon submission of the central body of executive power in the sphere of cultural heritage protection;
b) monuments of local significance by the decision of the central body of executive power in the sphere of protection of cultural heritage upon submission of the respective bodies for protection of cultural heritage or upon submission of the Ukrainian Society for Protection of Historical and Cultural Monuments, other public organizations which statutory tasks include the issues on protection of cultural heritage, during one month starting from the day of submission receipt.
The central body of executive power in the sphere of protection of cultural heritage shall issue to the owner of monument or authorized by it body the certificate about registration of the object of cultural heritage as a monument.
Submission about registration of monuments in the World Heritage List shall be conducted by the Cabinet of Minister of Ukraine upon recommendation of the central body of executive power in the sphere of protection of cultural heritage and Ukrainian National Committee of the International Council on Monuments and Sites (ICOMOS).

The monument, except for archaeological monument, may be in state, communal or private ownership. All archaeological monuments, including those located under water, as well as movable objects related to them, regardless of ownership form of the territory or water object where they are located, are state property. The owner or authorized by it body, the user shall keep the monument in a proper condition, timely repair it, protect from damage, destruction or elimination in compliance with this Law and protection agreement.

The Verkhovna Rada of Ukraine approves the list of monuments which shall not be privatized.

It shall be prohibited to ruin, change, move (transfer) to other places the monuments, their parts, movable property and real estate related to them. Ruin, change, transfer of monuments to the other place shall be allowed as exception on permit of the Cabinet of Ministers of Ukraine upon submission of the central body of executive power in the sphere of cultural heritage protection. 

Protection of cultural heritage shall be financed at for money of general and special funds of the State Budget of Ukraine, the budget of the Autonomous Republic of Crimea, local budgets. Measures in the sphere of cultural heritage protection may be financed by:
- the owners of monuments or authorized by them bodies or persons who acquired the right to own, use or manage monuments;
- customers of works related to transfer or reconstruction of objects of cultural heritage;
- charity contributions and donations;
- other sources which are not prohibited by the current legislation.

The state shall conduct preferential taxation policy in the sphere of cultural heritage protection.

Each monument has property value which is calculated in a monetary unit of Ukraine. The monuments shall be subject to monetary evaluation according to norms and methods approved by the Cabinet of Ministers of Ukraine.

The body for protection of cultural heritage shall impose the following financial sanctions on legal entities:
- for any illegal works which may damage the monument, its territory, protected archaeological territory, protected zones, historical areas of inhabited places - in amount from one to ten thousand minimum personal tax-free incomes;
- for non-adherence to requirements regarding protection, saving, maintenance, use, restoration, rehabilitation of monuments, including the requirements which are envisaged by protection agreements - in amount from one hundred to one thousand minimum personal tax-free incomes;
- for non-presenting, untimely presenting or presenting false information about the objects of cultural heritage, which were revealed in the process of land, building, road, melioration and any other works - in amount from one hundred to one thousand minimum personal tax-free incomes.

If the international agreement, which was approved as obligatory by the Verkhovna Rada, sets the rules other than those envisaged by the legislation of Ukraine on protection of cultural heritage, the rules of international agreement of Ukraine shall apply.
