"On Amendments to Certain Laws of Ukraine Relating to Additional Guarantees for Social Protection of Military Servicemen During the Special Period"

The Law supplements Article 10-1 of the Law of Ukraine "On Social and Legal Protection of Military Servicemen and Their Family Members" with new provisions that envisage the following:
  • during the special period, starting from announcement of mobilization until declaration of martial law, or until a demobilization decision is made, annual basic leave is granted to military servicemen under the condition that no more than 30 percent of the total number of military servicemen of a certain category in the respective unit are absent at the same time;
  • during the special period, while martial law is in effect, military servicemen can be granted paid leave for family reasons and other valid reasons, for a term not exceeding 10 calendar days;
  • other types of leave to military servicemen during the above periods are suspended, except for leave granted to female military servicemen due to pregnancy and childbirth, for taking care of a child under the age of three, and in cases when the child requires home care, for a term specified in the medical opinion, but no longer than until the age of six; as well as leave related to illness or for treatment after a severe injury, based on the opinion (resolution) of the military medical commission.

The Law also amends Article 26 of the Law of Ukraine "On Military Duty and Military Service", clarifying the provision on dismissal of military servicemen from military service during the special period.
