"On Amendments to the Laws of Ukraine "On Education" and "On Mobilization Preparation and Mobilization" Relating to Guarantees for Students, Post-Graduate Students, Educators, and Academic Teachers"

The Law supplements Article 51, part 1 of the Law of Ukraine "On Education" with a new provision, according to which trainees, pupils, students, cadets, participants, apprentices, medical residents, post-graduate students, and doctoral students are also granted a state-guaranteed right to:
  • retain their training place during the period of their enlisted military service during mobilization, during the special period;
  • postpone their examination session and state certification in educational institution for the period of their enlisted military service during mobilization, during the special period.

Article 53 of the Law of Ukraine "On Education" was supplemented with a new part, according to which students and post-graduate students in military service, mobilized during the special period, retain additional types of social and material support provided for by the Law of Ukraine "On Education".

According to the Law, if an educator or academic teacher develops a medical condition that makes it impossible for them to carry out their professional duties and restricts their presence in a collective of children, pupils or students, or if they are temporarily transferred to another job due to the above or other circumstances, or if they are in military service, mobilized during the special period, such educator or academic teacher shall retain their previous average salary (amended Article 57, part 3 of the Law of Ukraine "On Education").

The Law supplements Article 61, part 5 of the Law of Ukraine "On Education" with a new provision, according to which the amount of payment for education, training, retraining, advanced training of staff, or for additional educational services for persons performing military service, mobilized during the special period, is decreased with regard to the interrupted and paid period of education.

The Law also supplements Article 23 of the Law of Ukraine "On Mobilization Preparation and Mobilization" with a new part, according to which students and post-graduates students in full-time education are also not subject to being mobilized to military service during the special period.
