"On Amendments to Certain Legislative Acts of Ukraine Relating to Protection of the        Rights of Disabled People"

The Law amends Article 161 of the Criminal Code of Ukraine, establishing criminal liability for:
  • direct or indirect restriction of rights or instituting direct or indirect privileges for citizens on the grounds of disability (fine of UAH 3,400 to UAH 8,500, or restriction of freedom for a term of up to 5 years, with or without deprivation of right to hold certain positions or carry out certain activity during a term of up to three years);
  • the above actions, accompanied with violence, deceit or threats, as well as carried out by an official (fine of UAH 8500 to UAH 17,000, or deprivation of freedom for a term of 2 to 5 years, with or without deprivation of right to hold certain positions or carry out certain activity during a term of up to three years);
  • the above actions that were carried out by an organized group of persons or that resulted in severe consequences (deprivation of freedom for a term of 5 to 8 years).

The Law also presents a new version of Article 2, part 2 of the Law of Ukraine "On the Foundations of Social Protection of Disabled People in Ukraine", according to which the term "reasonable accommodation" and "universal design" are used in the meaning given in the Convention on the Rights of Persons with Disabilities and the Law of Ukraine "On the Principles of Prevention and Counteracting Discrimination in Ukraine".
