"On Amendments to Law of Ukraine "On the Permit System in the Field of Economic Activity" to Improve the Procedure of Issuing Licensing Documents Prepared by Central Executive Authorities"

The Law amends Article 1 of the Law of Ukraine "On the Permit System in the Field of Economic Activity" as follows:
  • the principle of organizational unity is a principle, according to which issue (reissue, issue of duplicates, annulment) of licensing documents to business entities and registration of declarations are carried out according to the procedure established by the legislation, through the licensing center, via interaction of the state administrator with representatives of licensing bodies central executive authorities, state collegial bodies, local and regional licensing bodies;
  • a licensing center is a permanent working body or organizational unit of an executive body of a city council in a city of regional and/or republican (in the Autonomous Republic of Crimea) importance, the Kyiv or Sevastopol city administration, district state administration, city district administration in Kyiv, or a ministry or republican committee authorized by the Council of Ministers of the Autonomous Republic of Crimea, through which licensing documents are issued (reissued, issued in duplicate, or annulled) and declarations accepted, observing the principle of organizational unity, via interaction of the state administrator with the above licensing bodies.

Amendments to Article 4 of the Law of Ukraine "On the Permit System in the Field of Economic Activity" establish the following:
  • the list of and requirements to documents that a business entity must submit in order to receive a licensing document are established exclusively by laws that regulate relations associated with procurement of licensing documents;
  • the issue (reissue, issue of duplicates, annulment) of licensing documents and registration of declarations by the above licensing bodies are carried out according to the principle of organizational unity, through a licensing center, except for cases and with regard to specifics determined by Article 2 of the Law of Ukraine "On the Permit System in the Field of Economic Activity";
  • a business entity has the right to be issued (reissued, issued duplicates, annulled) licensing documents and to submit declarations at their location, or in cases provided for by law, at the place of activity or location of facilities. The above licensing bodies ensure that the principle of organizational unity is observed by participating in the work of the permit center and interacting with state administrators through their representatives and/or electronically, through telecommunication. Local and regional licensing bodies, by decision approved with the body that created the licensing center, can provide for presence of their representatives in the licensing center premises, to take part in its work and interact with state administrators. The above licensing bodies which did not provide for the presence of their representatives in the licensing center premises take part in the work of the licensing center and interact with state administrators electronically, through telecommunication. A business entity can address a licensing body for consultation, through its representative in a licensing center or through telecommunication (telephone, e-mail, other forms of communication);
  • the above licensing bodies are forbidden to accept applications of business entities for issue (reissue, issue of duplicates, annulment) of licensing documents and declarations, or to issue such documents, if such documents are issued/accepted through a licensing center. According to law, the issue (reissue, issue of duplicates, annulment) of licensing documents and submission of declarations can be carried out through the Single State Portal of Administrative Services;
  • a business entity has the right to carry out certain actions related to business activity or types of business activity on the basis of declaration, without procuring a licensing document, except for types of business activity, the list of which is determined by the Cabinet of Ministers of Ukraine. The declaration is registered by a licensing body, free of charge, within five working days of declaration receipt. Denying registration of a declaration is forbidden.

Licensing documents are issued free of charge, for an indefinite term, unless otherwise provided by law (amended Article 4-1, part 1 of the Law of Ukraine "On the Permit System in the Field of Economic Activity").

Amendments to Article 5 of the Law of Ukraine "On the Permit System in the Field of Economic Activity" clarify the legal status of a state administrator.

The Law presents a new version of Article 7 of the Law of Ukraine "On the Permit System in the Field of Economic Activity", which establishes the procedure for the issue (reissue, issue of duplicates, annulment) of licensing documents by licensing bodies through a licensing center.
