"On Amendments to the Law of Ukraine "On the Unified State Demographic Register and the Documents that Confirm the Citizenship of Ukraine, Identify a Person or Their Special Status"

The Law of Ukraine "On the Unified State Demographic Register and the Documents that Confirm the Citizenship of Ukraine, Identify a Person or Their Special Status" N5492-VI of November 20, 2012 determines the legal and organizational principles of creation and functioning of the Unified State Demographic Register and of issuing documents that identify a person, confirm citizenship of Ukraine or a person's special status, as well as the rights and obligations of persons in whose name such documents are issued.

Article 3 of the Law of Ukraine "On the Unified State Demographic Register and the Documents that Confirm the Citizenship of Ukraine, Identify a Person or Their Special Status" provides definitions of terms used in it.

Amendments to Article 3 of the Law of Ukraine "On the Unified State Demographic Register and the Documents that Confirm the Citizenship of Ukraine, Identify a Person or Their Special Status" clarify definitions of the terms "biometric data" and "personal identification" by cancelling separation of biometric data into basic and supplemental. The Law also makes appropriate amendments to Article 7, and Article 19, part 2 of the Law of Ukraine "On the Unified State Demographic Register and the Documents that Confirm the Citizenship of Ukraine, Identify a Person or Their Special Status".

Information contained in the Unified State Demographic Register is defined by Article 7 of the Law of Ukraine "On the Unified State Demographic Register and the Documents that Confirm the Citizenship of Ukraine, Identify a Person or Their Special Status".

The Law amends Article 7 of the Law of Ukraine "On the Unified State Demographic Register and the Documents that Confirm the Citizenship of Ukraine, Identify a Person or Their Special Status", providing that digitized fingerprint data, at the owner's consent, shall also be entered into the Unified State Demographic Register (in case of issuing a foreign passport of a citizen of Ukraine, a diplomatic passport of Ukraine, a service passport of Ukraine, personal identification of a sailor, personal identification of a crew member, personal identification of a stateless person for foreign travel, or travel document of a refugee).

The Law supplements Article 7 of the Law of Ukraine "On the Unified State Demographic Register and the Documents that Confirm the Citizenship of Ukraine, Identify a Person or Their Special Status" with a new part, which establishes the following:
  • the procedure for collection of digitized fingerprints, their exclusion from the State Demographic Register, and their destruction, is established by the Cabinet of Ministers of Ukraine;
  • after being entered into a contactless electronic carrier, a person's digitized fingerprints are excluded from the Unified Demographic Register and destroyed;
  • the authority to receive digitized fingerprints and ensure their protection according to the legislation is granted to officials of the authorized body and to foreign diplomatic institutions of Ukraine;
  • if a person, due to their religious beliefs, refuses to give consent for their digitized fingerprints to be entered into a contactless electronic carrier, they are granted the right under Article 16, part 2 of the Law of Ukraine "On the Unified State Demographic Register and the Documents that Confirm the Citizenship of Ukraine, Identify a Person or Their Special Status";
  • a person's digitized fingerprints are collected after the person reaches the age of twelve.

Article 19 of the Law of Ukraine "On the Unified State Demographic Register and the Documents that Confirm the Citizenship of Ukraine, Identify a Person or Their Special Status" determines information that is contained in documents issued under this Law with the use of the Unified State Demographic Register. According to Article 19, part 2 of the Law of Ukraine "On the Unified State Demographic Register and the Documents that Confirm the Citizenship of Ukraine, Identify a Person or Their Special Status", saved onto a contactless electronic carrier shall be: information on the data page of the document, a person's biometric parameters, supplemental (optional) biometric data, and data to ensure protection of information stored on the contactless electronic carrier according to ICAO documents, unless otherwise provided for by the Law of Ukraine "On the Unified State Demographic Register and the Documents that Confirm the Citizenship of Ukraine, Identify a Person or Their Special Status".

The Law also supplements Article 19, part 2 of the Law of Ukraine "On the Unified State Demographic Register and the Documents that Confirm the Citizenship of Ukraine, Identify a Person or Their Special Status" with a new provision, according to which a person's digitized fingerprints, at their consent, are entered into a contactless electronic carrier in case of issuing a foreign passport of a citizen of Ukraine, a diplomatic passport of Ukraine, a service passport of Ukraine, personal identification of a sailor, personal identification of a crew member, personal identification of a stateless person for foreign travel, or travel document of a refugee.
